Terms of Use
1. Scope
These terms of use govern the use of the cutspool service, provided by Marcel Kremer Einzelunternehmen (hereinafter "we"). By registering for or using the service you agree to these terms.
2. The service
cutspool turns long-form video uploads into finished vertical clips for platforms such as TikTok, Reels and Shorts. The available functionality depends on the plan you choose and on your credit balance. We develop the service continuously and may add or adjust features.
3. Account
Using the service requires an account. You undertake to
- provide accurate information when registering,
- keep your credentials confidential and
- notify us without delay of any unauthorised use of your account.
You are responsible for all activity under your account.
4. Credits, subscriptions and billing
Processing runs are billed in credits according to the source-video duration. Paid plans are handled through Stripe and renew automatically unless cancelled. Credits included in a plan renew monthly; add-on credits purchased separately do not expire at the end of the period. You can cancel your subscription at any time, effective at the end of the current billing period, through the customer portal. We announce price changes with reasonable notice.
5. Acceptable use
You undertake not to use the service in order to
- infringe applicable law or third-party rights (in particular copyright, trade mark and personality rights),
- create or distribute unlawful, misleading or abusive content,
- transmit malware or misuse or overload the infrastructure.
A breach may lead to suspension or termination of the account.
6. Content and rights
You retain all rights to the content you provide and the media you upload. You warrant that you hold the necessary rights to that content. You grant us the simple right required to operate the service, namely to store and process this content in order to render and deliver your videos.
7. AI features
AI-generated clip selections, titles, descriptions and hashtags may contain errors. You are responsible for reviewing and using the generated content. No particular fitness or accuracy of the results is warranted.
8. Availability
We aim for high availability of the service but cannot guarantee uninterrupted availability. Maintenance, faults or circumstances outside our control may lead to temporary restrictions.
9. Limitation of liability
We are liable without limitation for intent and gross negligence and under the German Product Liability Act. In cases of slight negligence we are liable only for breach of a material contractual obligation, and limited to the foreseeable damage typical for this type of contract. Liability is otherwise excluded.
10. Termination
Either party may end the contractual relationship at any time. After you delete your account, your content is removed in accordance with our privacy policy. You can request an export of your data in your account settings beforehand.
11. Changes to these terms
We may amend these terms of use. We will inform you of material changes through the service in good time.
12. Governing law
The law of the Federal Republic of Germany applies. Disputes are settled before the German courts.
